The
use of DNA testing has proven that most wrongful convictions have been
contributed by eyewitness misidentification. Across the United States to date, DNA
testing has led to over 70% of convictions being overturned. Norris (2017)
asserts that the human mind does not record or recall the exactly how an event
unfolded. The memory of a witness is influenced by different factors from the
moment a crime occurs onwards; therefore, such memories are easily contaminated
due to formation of false memories.
The
Innocence Project in collaboration with policymakers and law enforcement
agencies has proposed five procedures such as recording, confidence statements,
instructions, blinded administration and line-up composition aimed at reducing
the instances of misidentification. These procedures help reduce wrongful
convictions by decreasing the number of misidentifications and addressing the
loopholes in the justice system (Kassin, Bogart,
& Kerner, 2012). These
procedures make court proceedings more efficient due to the minimization of
cases of evidence being mishandled or compromised.
