current rules governing search and seizure revolve three prime question. The
first question is whether police seized or searched anybody or anything. Is the
answer is yes, the rule leavers police’s actin uncontrolled (Mannheimer, 2018).
On the flip side if the answer is yes, what justification must the police
officer have-reasonable suspicion, probable cause or something different?
Ultimately, what protocols must police adhere to-must the police ask for
permission from the magistrate, or should they search the person first then
defend themselves in the suppression hearing later?
In defining seizure and search the most significant question to consider is the first one, whether a given police tactic is not a seizure or search as outline in the Fourth amendment that police are a allowed to free use their tactics of their wish without legal restrictions. The Fourth Amendment defines searches as the police tactics that infringes a reasonable expectation of privacy ((Mannheimer, 2018). The amendment adds that a reasonable expectation is a type expectation any other individual is entitled to have.
