4th
Amendment
Internet
privacy
Generally,
the 4th Amendment regulates access to personal information. The
Amendment deters the government and any law enforcement agency from searching and
accessing personal data without a warrant. Although the policy was established
before digital errors, evidence-based practices, and court rulings on cases
related to data access, have expanded the Amendment to provide privacy and
security for data held in digital devices. The Amendment considers it a
violation of privacy and security rights when the government searches personal
gadgets, including wearable devices, mobile phones, and smart cars, without a
warrant. Hecht-Felella(3) maintains that
the government should preserve the balance between the government and its
citizens as enshrined in the Fourth Amendment. It Protect suspects from home
and property surveillance without the suspect knowledge. For instance, in 2018,
the United States Supreme court's decision in Carpenter v. the United States
demonstrated that it is not only unlawful to glean data by connecting mobile
phones with nearby towers but also a violation of data security and personal privacy.
"The Court ultimately held that when the government demanded seven days of
location information from defendant Timothy Carpenter's cell phone provider
without a warrant, it violated the Fourth Amendment” (Hecht-Felella, 3). This
means that the Fourth Amendment requires that government and law enforcers to
obtain warrants before deploying location tracking technologies such as GPS and
beepers in gleaning personal information.
Internet
Freedom in the US Compared to other Countries (UK and India)
Different
governments across the globe have raised concerns about the degree of freedom
people should have in posting content on the Internet. Research shows that
although countries such as the United States of America, the United Kingdom,
and India allow citizens to post content of their wish on the Internet, they
limit their internet freedom significantly. In the United States of America,
internet users have limited freedom of posting and accessing data information
from online platforms. The report given by Freedom House in the United States
of America showed that internet freedom in the United States of America has
significantly declined for the past five consecutive years (McLaughlin). The Federal government has taken
the initiative to tighten Internet control to subdue free expression. The
initiative aims to prevent business entities from growing beyond reproach and
misinformation to flourish online. Also, the United Kind government exerts some
degree of control over what internet users can post or access from the
Internet. The UK government introduce online safety to regulate the type of
content hitting the internet platforms (GOV.UK).
Although the bills give online users freedom of posting, it prohibits people
from sharing content harmful to children over the Internet. The government
forces users to comply with regulations and blocks non-compliant individuals
and companies. Similarly, India has experienced a significant decline in online
freedom. According to (Staff), internet
freedom in India declined from 55% in 2018-2019 to 51% in 2019-2020. The Indian
government initiated to facilitate good internet access, information security,
and privacy.
