Landmark Court Case I: Board of
Education vs. Rowley, 1982
Background
Amy Rowley was
a handicapped student in Peekskill, New York. Her parents were both deaf, but
they had negotiated with institutional administration to provide an individualized education program (IEP) for
Rowley. The program was aimed to provide a sign language interpreter. However,
after a period of 14 days of services, the interpreter indicated Rowley could
learn with assisted interpretations. Therefore, Rowley depended on FM hearing
aid for the remaining part of the year. When Rowley joined first grade, the
administration prepared another individualized education program as per the
requirement by the Education for Handicapped Act that enacted in the
United States in 1975. However, the new program did not allow Rowley to have an
interpreter in class; consequently, Rowley filed a suit in the American
district court (Gallegos,
1989).
Ruling
The case was heard and determined between September and October of 1979, where Vincent Broderick of the U.S. District Court ruled that Rowley was receiving less than the minimum threshold level of learning acceptable in class. "Each handicapped child being allowed to achieve his/her full potential commensurate with the opportunity provided other children” (p. 534).
