INSTRUCTIONS:
During this chapter, I presented information from the CA Penal Code related to how crimes are "classified" as either Infractions, Misdemeanors or Felonies, based on the severity of the criminal acts described and their accompanying allowable punishments. These punishments include fines, imprisonment in county jails and/or state prisons, and even the Death Penalty for some very serious felonies. The purpose of this Discussion Board is to start you thinking more about the nature, fairness and effectiveness of how we traditionally punish convicted criminals within our Criminal Justice System... Add examples to each answer of the questions Directions: 1. Answer the following questions in a short paragraph of a few-to-several complete sentences Are the existing punishments listed above fair and reasonable for the crimes classified as Infractions, Misdemeanors and Felonies in the CA Penal Code? Are these punishments an effective way of punishing convicted criminals? What, if any, alternative methods of punishment do you think would be more fair, reasonable and effective? ___________________________________________________________________________ PAGE 2/PART 2 Ch. 2 Review Questions COMPLETING AND SUBMITTING YOUR ASSIGNMENT: A thorough response for each of these questions should contain detailed information, explanations and examples... A brief sentence or two will probably not suffice to earn full credit! This assignment should be written using complete sentences, proper formatting, paragraphing, etc. Answer each of the following questions in well-constructed type-written response: Explain and give an example of the concepts of “Letter of the Law” and “Spirit of the Law” as they relate to the administration of criminal justice. What are the three classifications of crimes in California, and what are the allowable punishments for each? What are “Wobbler” crimes, and how are they defined and handled within the justice system from arrest through prosecution and sentencing? What is meant by “Diminished Capacity” and why was it abolished as an allowable defense in CA? Explain and give specific examples of how some crimes are considered as “lesser included” offenses.
