In this case, Acme Equipment is the offeror by prompting to sell the dough-cutting machine. The second element is that an offer must be communicated. Communication in an offer entailed sharing information about what is being sold, its nature, where it is being sold from, as well as the time when the offer will be closed. According to the depicted case study, between Acme Equipment and Big Bagels, it is clear that the communication took place because the offer closing date had also been communicated. The other element of a valid offer in a contract is that it must have an offeree and a consideration. In this case, Big Bagels was the offeree by prompting to want to buy the dough-cutting machine.
