Justice is a term that most lawmakers and implementors always insist on. The main question remains, does every suspect get fair healing, hence, yielding justice? Probably this is a question that will never be answered fully. The main reason for the lack of clarity on this matter is the fact that "justice" in a criminal proceeding could be overturned due to the lack of sufficient evidence. Indeed, a crime might have happened, but a lack of evidence and the use of insufficient methods may criminalize the wrong person. When a crime occurs, prosecutors and concerned police departments are tasked with securing a crime scene and gathering as much viable evidence as possible. This process is not entirely straightforward; in fact, it takes a team of detective experts to assemble different pieces of evidence used during court ruling and prosecution. In such a case, the process of revealing the innocent and the offended party becomes complicated and could even take years to solve. An excellent example of a situation that took a prolonged determination period involved Brendan Dassey. Based on material gathered and court proceeding, Brendan Dassey is innocent because no DNA evidence was used during the 2007 conviction, inappropriate use of Reid techniques, and prosecutors dominated conversation during interviews.

Brendan Ray Dassey had his life turned around on the negative side when he was 16. Brendan Dassey was brought up alongside four brothers, and he always used to be reserved. He was considered as having an extremely low IQ to a point where he took lessons in special classes. However, due to his reserved nature, people perceived him as "tender" and less aggressive in many ways. It was until when he was 16 that he and his uncle Steven Avery were convicted for the murder of Teresa Halbach, a photographer in their locality. However, despite several turnings of events, Brendan Dassey can be considered innocent for many reasons, as argued below.

First, No DNA evidence was used during the 2007 conviction. The importance of conducting a DNA analysis cannot be overlooked during the determination of such a critical case. In the incidence of Brendan Dassey, the ruling made in 2007, and as presented by the transcribed court proceedings, the trial was anchored on garnered interrogations. Relying on the investigation collected during the suspect interviews can potentially lead to making the wrong determination during a case trial. According to Schafer, using inquiries can have detrimental implications to a case ruling since a suspect can easily be lured into saying something that will make them appear guilty. Therefore, DNA should have been used since it is very important in uncovering criminals who do not abide by telling the truth concerning a particular incidence. The PCR is useful in pairing suspects with particular accounts of an investigation. For example, the case that Dassey was involved with had the elements of rape and murder.
